These terms are an agreement between you and Ms Busy Fit, a personal training studio in Ontario, Canada (“we”, “us”). They cover the Ms Busy Fit mobile app and the coach console at web.msbusyfit.com (together, the “Service”). By creating or using an account you agree to them. If you do not agree, do not use the Service.
1. Who can use the Service
You must be 18 or older. Client accounts are created by invitation from a Ms Busy Fit coach; coach accounts are created by the studio owner. You are responsible for keeping your sign-in details private and for everything done under your account. Tell us at once if you think someone else has access to it.
2. What the Service is, and is not
The Service delivers the training, nutrition and habit programme your coach has designed for you, lets you log what you do, and lets you and your coach communicate. It is a tool for coaching. It is not medical care, and nothing in it is a diagnosis, treatment or a substitute for advice from a physician or registered dietitian.
Before starting any programme, and before changing it because of pain, illness, pregnancy or a medical condition, consult a qualified health professional. Stop any activity that causes pain or feels unsafe and tell your coach. You take part in physical activity at your own risk and are responsible for training within your own limits and using equipment correctly.
Progress statistics, streaks and AI-generated summaries are produced automatically from what has been logged. They can be wrong or incomplete. Your coach, not the software, makes coaching decisions.
3. Your coaching relationship
The coaching services themselves, including fees, cancellation and scheduling, are governed by the agreement you have with Ms Busy Fit or your coach outside the app. The app does not take payments. These terms cover the software only.
4. Your content
You own what you put into the Service: your logs, photos, videos, messages, posts and uploads. You give us a licence to store, process and display that content to you, your coach and (for community posts) other members of the studio, so that the Service can work. The licence ends when the content is deleted, subject to backups and the retention described in our Privacy Policy.
You must have the right to share anything you upload. Do not post content that is unlawful, harassing, sexually explicit, that promotes disordered eating or dangerous training practices, that infringes someone else’s rights, or that reveals another person’s private information. We may remove content and suspend accounts that break these rules.
5. Our content
Programmes, workouts, exercise videos, meal plans, recipes, ebooks and the app itself belong to Ms Busy Fit or our licensors. They are for your personal use while you are a client. Do not copy, resell, redistribute or share them outside the app, and do not reverse engineer, scrape or interfere with the Service.
6. Community and messaging
The community feed and challenges are shared spaces for members of the studio. Be respectful. Coaches and the studio owner can see all messages and posts inside the studio and may moderate them. Do not use the Service to contact other clients outside the app without their consent.
7. Connected services
If you connect Apple Health, Fitbit or Oura, you authorise us to read the data described in the Privacy Policy. You can disconnect at any time. Those services have their own terms, which apply to your account with them.
8. Ending your account
You can delete your account at any time from Settings in the app, or by following the steps at web.msbusyfit.com/delete-account. We may suspend or close an account that breaks these terms, is inactive, or when the coaching relationship ends. What happens to your data on deletion is set out in the Privacy Policy.
9. Availability and changes
We work to keep the Service available, but it is provided “as is” and may be interrupted for maintenance, updates or reasons outside our control. We may change or discontinue features. We may update these terms; the date at the top will change and, for material changes, we will tell you in the app before they take effect. Continuing to use the Service after that means you accept the new terms.
10. Disclaimer and limitation of liability
To the fullest extent permitted by law, we make no warranties about the Service, its accuracy or its fitness for a particular purpose, and we are not liable for indirect, incidental or consequential loss, or for injury arising from your own physical activity, except where the law does not allow that limitation. Where liability cannot be excluded, it is limited to the amount you paid us for the software in the twelve months before the claim, which for the app itself is nil. Nothing here limits liability for death or personal injury caused by our negligence, or for anything else the law does not allow us to limit.
11. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be heard in the courts of Ontario, unless the consumer protection law where you live gives you the right to bring it elsewhere.
